Wendy

In advance of the Electoral Commission's conclusion on Wendy's dodgy donation I thought I'd choose this time to restate my opinion on the affair.

For me, Wendy's 'sins' sit in between those of Peter Hain's and Allan Johonson's.

Peter Hain's actions have led him to be referred to the police and the sums involve amount to hundreds of thousands of pounds. Of course he should have resigned.

Allan Johnson does genuinely seem to have complied with the law regarding his £3,334 donation. For me it seems it was the donor that has acted (at worst) sloppily. Of course he deserves to stay on.

Which brings me to Wendy Alexander.

She has broken the law which Scots and Independent is at pains to reinforce.

For me though, the overriding decision that people must make is do we really care? It's £950 for a contest in which Wendy was the only candidate. And I wager there would be very few people who would want to see her head roll for such an innocuous crime. So let's give her the token slap on the wrist and move on.

Doing 80mph in a 70 zone or not wearing your seatbelt involve instances where one has broken the law. Any sort of punishment for either of the above is generally seen as heavy-handed and, for me, Wendy's £950 is nothing more than the political equivalent of 'unintenionally' going over the speed limit. One has to really ask if an Electoral Commission and even a police investigation is really worth the time and money involved.

Will Holyrood be a better place for having a chastised and chastened Wendy Alexander at the helm of the Labour Party? Are people outwith the Holyrood Bubble baying for her blood? Is there anyone else in the Labour ranks who could do as able a job as she?

The answer to all of the above is a resounding "no" so let's hope the journalists and opposition parties end this charade of outrage and dismay and we can let Wendy get back to shooting her mouth off in First Minister's Questions and getting smacked back down by Alex every week.

Hmm. A few things about this.

Firstly, I was caught doing 80 in a 70 at 9.40am on a Sunday on an empty dual carriage-way but it didn’t stop me being fined £80 and getting three points on my license. If a law is in place it must be observed (honest guv). Ignorance of the law is no defence, neither is unintentional law breaking – try these excuses next time you’re in the dock, the judge will have a field day with you.

Personally, I would like to see her go for a number of reasons. Firstly, she has broken the law. “No ifs, no buts”. Secondly, this law is viewed with great amusement by parties in Holyrood at the expense (no pun intended) of the SNP and King Connery III of Scotland (currently on sabbatical).

Token slap on the wrist or a return to Grassmarket Justice? Who am I to decide? It must, however, be conceded that Wee (Wendy) Eck has a case to answer and, accordingly, a reprimand to endure.

Ouch, my genuine condolences about the fine and points. I always thought 80 was a 'blind eye' offence but given that I'm largely a public transport traveller I guess I'm out of the loop.

Your comment regarding Sean Connery is interesting. Of course I fully appreciate the mirth involved in this entire situation, a mirth I like to dabble in myself, though I'm not as dyed-in-the-wool SNP as some.

But to connect King Connery with Wendy's situation highlights the chink in your tartan armour. The law is not a tit-for-tat arrangement.

I can't really argue with your "no ifs, no buts". you choose to take a more prescriptive approach to the law compared to my somewhat laissez-faire attitude. Neither argument is inherently correct but I still strongly believe most people would rather see her stay and in a democracy surely that counts the most?

As an example, my only brush with the law was a bit of jay-walking in LA as a naive 19 year old. I got stopped by a state-trooper who saw me, he checked my passport and reminded me of the law. Now under your "no ifs, no buts" philosophy, what do you think he should have done? I'd like to add there wasn't a car in sight at the time (though to be fair, I didn't spot the state trooper!)


And how about this for a different tack with Wendy. People are generally punished to make sure they don't reoffend. If everything just stopped now for Wendy, no police, no Electoral Commission, I bet my bottom euro that Labour will be checking every donation with a fine toothcomb from here on in.

And that, surely, is the result we all want. Unless we have our SNP-tinted glasses on of course.


I just worry that if the SNP push too hard for heads to roll it is the good guys, bizarrely, who will come out looking bad after all of this.

Thank you for the sympathy. Needless-to-say, I was fuming at the time…

I agree with your tit-for-nat (sic) argument (not that I would ever refer to Wee Eck as a tit). However, because of the King this law is well known by all in Holyrood and all should have been vigilant. This only makes it more difficult to comprehend why it was missed.

There is one difference between your jay walk and Wendy. You do not hold a position of public office and, therefore, are subjected to less scrutiny. If you had been travelling the U.S. promoting a campaign to stamp out zig-zagged road crossing you would have deserved punishment. Why do politicians have to get caught before they decide to “check every donation with a fine toothcomb from here on in”? They knew the rules/laws and should make it their business not to break them.

I think that the real issue hear is the entire system of party political donations. We have two, perhaps three, options.

Firstly, open up the system to a limitless free for all – as seen in the pillar of democracy and transparency that is the good ol’ U. S. of A.

Secondly, put a cap on all donations – yes, all, including the trade unions.

Thirdly, create an election campaign tax.

The status quo is clearly too confusing for the holders of our public offices.
